Tourex Terms of Use

Welcome to Tourex! These Terms of Use (“Terms”) govern your access to and use of the Tourex platform, located at tourex.cw, and all related services, features, content, and applications (collectively, the “Services”).

Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, you may not access the Services.

User Accounts and Eligibility

  • Account Creation: To access certain features of the Services, you must create a user account. You agree to provide accurate and complete information during registration and to keep this information updated.
  • User Types: Our platform serves two main types of users:
    • Job Seekers: Individuals seeking employment.
    • Employers: Businesses or individuals seeking to hire employees.
  • Eligibility: You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement.
  • Account Security: You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach of your account.

Description of Services

Tourex provides a platform that connects job seekers with employers.

  • For Job Seekers: You can create a professional profile, upload your resume, search for job postings, and submit applications directly to employers.
  • For Employers: You can create a company profile, post job openings, manage applications, and search our database of job seeker profiles.

Disclaimer: Tourex is a platform and a venue. We are not an employment agency and are not involved in the actual hiring process, interviews, or employment decisions. We do not make any representations or guarantees about the suitability, integrity, or conduct of any user, nor do we assume any responsibility for the accuracy of content posted by users. Your interactions with other users are solely at your own risk.

User Responsibilities and Prohibited Conduct

You agree to use the Services in a manner that is lawful and in compliance with these Terms. You are prohibited from engaging in the following activities:

  • Posting any false, inaccurate, or misleading information, including fake job postings or resumes.
  • Using the Services for any illegal purpose, or in violation of any applicable local, national, or international law.
  • Uploading or transmitting any content that is harmful, threatening, abusive, harassing, defamatory, vulgar, or obscene.
  • Impersonating any person or entity or misrepresenting your affiliation with a person or entity.
  • Infringing upon the intellectual property rights of others, including copyright, trademark, or patent.
  • Disrupting or interfering with the security of, or otherwise abusing, the Services, or any services, system resources, accounts, or networks connected to or accessible through the Services.
  • Engaging in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

Fees and Payment (for Employers)

  • Billing: Some of our Services, such as premium job postings or access to candidate databases, may require a fee. When you use a paid Service, you agree to our pricing and payment terms, which are provided at the time of purchase.
  • Payment Processing: We use third-party payment processors to handle all financial transactions. We do not store your credit card information.
  • No Refunds: Unless stated otherwise at the time of purchase, all fees are non-refundable.

Intellectual Property

  • Our Rights: All content and materials on the Services, including text, graphics, logos, images, and software, are the exclusive property of Tourex or its licensors and are protected by intellectual property laws. You may not use, copy, modify, distribute, or create derivative works from our content without our express written permission.
  • User Content: You retain all ownership rights to the content you submit to the Services, such as resumes, profiles, and job postings (“User Content”). However, by submitting User Content, you grant Tourex a non-exclusive, worldwide, royalty-free, and perpetual license to use, display, reproduce, and distribute your User Content on the Services and in our marketing materials, subject to our Privacy Policy.

Disclaimers and Limitation of Liability

  • No Warranties: The Services are provided “as is” and “as available” without any warranties of any kind, whether express or implied. Tourex does not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee job placement for job seekers or successful hires for employers.
  • Limitation of Liability: To the fullest extent permitted by law, Tourex and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with these Terms or your use of the Services, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Tourex and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any rights of another user or third party.

Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Curaçao, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Curaçao, and you consent to the exclusive jurisdiction of such courts.

Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Services after the effective date of the new Terms constitutes your acceptance of the changes.
